It is a term and condition of a reader accessing and reading the Sybian Toronto website - ST onward. ST is the trading name for our website, registered in Canada, North York, Toronto.

This page along with our Privacy Policy, Returns Policy, How It Works page and Delivery Policy provides you information about us and the legal terms and conditions on which we provide any of the goods and services listed on our website to you.

These terms apply to any contract between us for the sale of products or services to you. Please read these terms carefully and make sure that you understand them, before ordering any products from our site.
Please note that by placing an order agree to these terms.
Terms and Conditions are regularly updated and maintained. We recommend you to read and review these prior to every order of goods and services to be familiar with the latest edition and ensure you understand the terms which will apply at that time.
Age of Consent
By placing an order for goods and/or services at Sybian Toronto, you declare that you are of the appropriate legal age to purchase the items. If we discover that you are not legally entitled to order certain goods, we will not be obliged to complete the order. We also require that you are 18+ years of age of the date of order or have reached the age of majority in your province.
The age of majority is 18 in six provinces: Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, and Saskatchewan. The age of majority is 19 in four provinces and the three territories: British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, and Yukon.
Contract Formation
All orders made by you through the ST website are subject to acceptance and availability. We may choose not to accept your order for any reason.
Prices of products are correct at the time of entering information, however, we reserve the right to change prices without prior notice (although we will inform you if any such price change affects your order).
For the avoidance of doubt, no contract will exist between you and ST for the sale by ST to you of any product unless and until ST sends you an e-mail confirming that it has dispatched your product.
Hygiene and Sanitation
We take cleanliness of the product seriously and your health and safety are our priority. Each machine is thoroughly sanitized with medical-grade cleaning solutions after every rental, making them safe after each use and hygienic to rent.

This is the main reason why we do NOT rent the attachments, all attachments selected with the rental are yours to keep. Only the mounts to be returned.
Cancellations
To cancel a contract in accordance with your legal right to do so, you just need to let us know that you have decided to cancel at least 48 hours before the requested rental date to receive full refund minus transaction fees of minimum $45 dollars. Please see our Shipment & Return Policy for more information. Order cannot be cancelled once it has been dispatched or within 24 hours dispatch window that we reserve to prepare machine for use and shipment. With that said, you still can cancel the order, however, you will not receive any refund on the rental fee. Only shipping fee and accessories cost will be refunded.
Data Protection and Privacy Policy
Sybian Toronto is compliant with the Data Protection Act. We only use your personal information in accordance with our Privacy Policy. We will not pass on your details to any third party without your prior consent.
Return Policy
Due to hygiene reasons, products that have been used cannot be returned except for the rental equipment. For your safety, we have to ensure that all shipped products are new, therefore we consider all products as being used once they are shipped. Please choose your items wisely. If you have a question about a product, ask us before you buy.

Any content of Sybian Toronto website, including text or images may not be copied or reproduced in any way except for your own personal non-commercial use. You hereby agree to follow copyright clause and not to create any derivative work from any of the material contained in this site. All materials and contents cannot be used for any purpose other than for your own personal use.
Disclaimer
ST provides website and contents 'as is' and does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials.
In addition, ST makes no (and disclaims all) representations or warranties of any kind, express of implied, with respect to the its website or the information or content included in this site.
This does not affect your statutory rights in relation to the goods and their fitness for purpose and satisfactory quality.
Use of Sybian Toronto website
In connection with the use of the ST website (including any orders of products), in no event ST will be liable:
- for losses that were not foreseeable to both parties when the contract was made
- for losses that were not caused by any breach on the part of the supplier
- for business losses and/or losses to non consumers
We do not in any way exclude or limit our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any breach of the terms implied by section 13 of the Sale of Goods Act, R.S.O. 1990 (title and quiet possession);
(d) any breach of the terms implied by section 14 to 16 of the Sale of Goods Act, R.S.O. 1990 (description, satisfactory quality, fitness for purpose and samples; and
(e) Return of defective products under the Consumer Protection Act, 2002;
You agree to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party, such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.

Jurisdiction
These Terms and Conditions are governed by the laws of Canada.
Sybian Toronto reserves the right to amend these terms and conditions from time to time.
Events outside of our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control (which means any act or event beyond our reasonable control).
If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:
(a) we will contact you as soon as reasonably possible to notify you; and
(b) our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
You may cancel a contract affected by an Event Outside Our Control. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.
General Safety and Use of Equipment and Services
We will not be reliable for any personal injuries or death caused by inappropriate use of our machines caused by any of the following:
- Not following manufacturer's user instructions;
- These products are sold and rented as a novelty only;
- There are to be no alterations or modifications to this product;
- No medical claims are warranted or implied by the use of this product;
- Use that has an adverse effect on any function of the human body is prohibited;
- To avoid injury or aggravation of pre-existing conditions, this product should not be used on bruised, swollen or inflamed areas including skin lacerations;
- Discontinue use immediately if irritation or discomfort occurs;
- This item should not be used to harm you or another person;
- Use this item at your own risk, with assumption of all liability;
- For any existing or suspected medical conditions, please consult with your doctor prior to use.
- We don't recommend to use our products during pregnancy.

Allergies:
- This product may contain or has come in contact with the following: animal hides, nickel, glycerine, silicone, latex, rubber, phthalates;
- Use the product on a small area of the body, with your allergic reaction protocols within immediate access to you, and wait to see if there are any allergies to the materials. If so, cease use immediately.
Taking in account that we do not produce the machines, nor products and accessories, we cannot guarantee allergen free products, nor be liable for any allergic reaction.

Terms and Conditions of Use - Safety Information and Statements
- Novelty Fucking Machines are a novelty item never intended to cause harm to yourself or another person;
- Novelty Fucking Machines are a novelty item never intended to cause harm to your own or another person’s physical property;
- Never use Novelty Fucking Machines in a manner that will cause bruising, swelling, general irritation, lacerations, inflammation, open wounds or any form of harm to another living being not covered in this statement;
- Never use Novelty Fucking Machines to put pressure on a user’s windpipe;
- Never use Novelty Fucking Machines to gag or choke a person;
- Always follow the commands of the user;
- Prior to using Novelty Fucking Machines the user must research the toy’s implied use to avoid causing harm to themselves or others;
- Novelty Fucking Machines are not intended to be inserted into the user’s or any person’s body without explicit consent;
- By using Novelty Fucking Machines the user and all involved are responsible for the following:
- always referencing the Novelty Fucking Machines manufacturer’s user manual prior to use,
- inspecting the Novelty Fucking Machines and all it’s internal and external parts for defects, flaws or degradation;
- using the proper power source for the Novelty Fucking Machines power supply as instructed by the manufacturer’s user manual,
- powering on the machine prior to human interaction,
- never using Novelty Fucking Machines without supervision,
- gaining explicit consent from another user prior to engaging in activity between themselves, yourself, and a Novelty Fucking Machines,
- providing the appropriate amount of personal lubricant to the user interacting with the Novelty Fucking Machine at all times,
- being aware of overheating, discrepancies in the machine’s movements, sparks from either the Novelty Fucking Machine or the power outlet,
- never restraining a person to the Novelty Fucking Machine in a manner that hinders that person’s ability to stop using the machine based on their specific physical and mental abilities,
- never using a Novelty Fucking Machine with, in or around water,

- You and/or the user has internal and/or external injuries;

- You and/or the user are pregnant.

Use Agreement
- I understand these products are for adult novelty use only and there are no implied medical claims warranted or implied by use of this product;

- I agree to never use a Novelty Fucking Machine to break the skin of myself or another being;

Additional Terms
We may transfer our rights and obligations under any contract to another organisation, but this will not affect your rights or our obligations under these terms.

You may only transfer your rights or your obligations under these terms to another person if we agree in writing.
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
